1. Introduction

Welcome to UPretty ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of the UPretty website located at upretty.ai and all related services, features, and content (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

2. Service Description

UPretty provides an AI-powered platform that allows registered users to generate images based on pre-configured themes and user-uploaded reference photos. Our Service utilizes Google's Gemini API for AI image generation. The Service includes browsing themes, uploading photos, generating AI images, downloading generated content, and managing user accounts.

3. Account Registration and Eligibility

To use certain features of the Service, you must create an account. You must be at least 13 years old to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information during registration and to keep your account information up to date.

4. Service Pricing and Usage Limits

UPretty is currently offered free of charge. Each registered account is allowed up to 10 image generations per 24-hour period, with the daily counter resetting at midnight. There is no payment, no credit card requirement, and no trial expiration. We reserve the right to change the daily limit or to introduce optional paid tiers in the future, with advance notice posted on the Service.

5. User Content and Conduct

You are solely responsible for the content you upload and the prompts you use. You agree not to use the Service to generate, upload, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable. We reserve the right to remove any content and suspend or terminate accounts that violate these Terms or applicable laws.

6. Data Retention and Deletion

Important: To ensure user privacy and manage storage efficiently, all images generated by users on UPretty are stored temporarily. Generated images will be automatically permanently deleted from our servers 30 days after creation.Uploaded reference photos are processed in real-time and are not permanently stored. Users are responsible for downloading and saving any images they wish to keep before the 30-day retention period expires. We are not liable for any loss of content after this period.

7. Intellectual Property

You retain ownership of the original photos you upload. Subject to these Terms, you own the images generated using your photos through our Service. However, UPretty retains all rights to the Service itself, including but not limited to the platform design, themes, prompts, algorithms, code, and branding. You may not reverse-engineer, decompile, or attempt to extract the source code of the Service.

8. Prohibited Uses

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to circumvent security measures; (c) use automated tools to scrape or extract data; (d) generate content that infringes third-party rights; (e) impersonate any person or entity; (f) distribute malware or harmful code through the Service; (g) use the Service to generate misleading deepfakes intended to deceive others.

9. Limitation of Liability

UPretty is provided "as is" and "as available" without warranties of any kind, either express or implied. To the maximum extent permitted by applicable law, we disclaim all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. In no event shall UPretty, its founders, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

10. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of the Service after any modifications constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Andhra Pradesh, India.
